Acceptance of terms
By creating an account, using the app, starting a ride, scanning a bike, entering a station code, or using any Boneshaker service, you agree to these Terms and any rental agreement, safety rules, and posted instructions provided in the app.
Eligibility
You must be legally able to enter into these Terms and meet all rider eligibility requirements in your operating area. You are responsible for complying with local laws, helmet requirements, traffic rules, and age restrictions.
Your account
You are responsible for the accuracy of your account information and for activity under your account. Keep your login credentials secure. Do not let another person use your account unless the app expressly supports adding and managing additional riders or rentals under your account.
Rentals and ride responsibilities
Before riding, inspect the bike and equipment. Do not ride if a bike appears damaged, unsafe, has a low battery warning, or is not operating properly. While riding, use caution, obey traffic laws, stay alert, and ride only where permitted.
- Do not ride under the influence of alcohol, drugs, or anything that impairs your ability to ride safely.
- Do not carry passengers unless expressly permitted by the vehicle type and local law.
- Do not modify, tamper with, damage, or disable any bike, lock, helmet, station, or tracking equipment.
- Return bikes only in permitted areas or stations and follow the in-app return instructions.
Ending a ride
A ride ends only when the app and service confirm that the ride has been completed. You may be responsible for charges, loss, damage, or continued use until the ride is properly ended, the bike is returned as instructed, and any required station code or lock step is completed.
Payments and fees
You authorize Boneshaker and its payment processor to charge your selected payment method for rides, fees, taxes, deposits, penalties, lost equipment, damage, unpaid balances, and other amounts owed under these Terms. Prices may vary by location, duration, bike type, promotions, or operational rules shown in the app.
Damage, loss, and prohibited conduct
You may be responsible for damage, theft, loss, fines, towing, impound fees, improper parking, misuse, or violations that occur during your rental or because of your use of the service. Report accidents, unsafe bikes, damage, and support issues promptly.
Service availability
Bikes, helmets, batteries, stations, network services, Bluetooth controls, maps, and app features may be unavailable, delayed, or inaccurate at times. We may pause, modify, suspend, or discontinue parts of the service for safety, maintenance, legal, operational, or business reasons.
App permissions and communications
Some features require device permissions, including location, Bluetooth, camera, notifications, and network access. You agree that we may send service messages related to your account, rides, payments, safety, support, and security.
Intellectual property
The Boneshaker name, logo, app, website, software, designs, content, and service materials are owned by Boneshaker or its licensors. You may not copy, modify, reverse engineer, scrape, or misuse them except as permitted by law.
Disclaimers
The service is provided on an "as is" and "as available" basis. Riding electric bikes involves risk. To the fullest extent allowed by law, Boneshaker disclaims warranties not expressly stated in these Terms.
Limitation of liability
To the fullest extent allowed by law, Boneshaker will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for losses caused by misuse, unsafe riding, third parties, network failures, unavailable bikes, or events outside our reasonable control.
Suspension and termination
We may suspend or terminate access to the service if you violate these Terms, fail to pay amounts owed, misuse equipment, create safety risks, provide false information, or use the service in a way that may harm Boneshaker, riders, partners, or the public.
Changes to terms
We may update these Terms from time to time. Continued use of the service after updates means you accept the revised Terms.
